Adams and Congress passed the Judiciary Act of 1801 and appointed several like-minded individuals into the courts before his departure from the presidency. Jefferson attempted to stop the appointments by ordering Madison not to send their commissions. The Court found that Madison's refusal to hand over the commissions was illegal but also that the Judiciary Act of 1789 was unconstitutional.
